Por 3 votos 2, a Segunda Turma do Supremo Tribunal Federal (STF) confirmou a decisão do Tribunal Superior Eleitoral (TSE) que, em março, cassou o mandato do deputado federal Valdevan Noventa (PL-SE). Com isso, foi derrubada a decisão liminar do ministro Nunes Marques que havia devolvido o mandato ao deputado. Assim, o deputado Márcio Macedo (PT-SE) deverá retornar ao cargo. 

Valdevan Noventa é acusado de abuso de poder econômico. No início do ano, o TSE cassou o mandato do parlamentar  e determinou a recontagem dos votos para a cadeira na Câmara dos Deputados. 

Ao levar o caso para julgamento, Nunes Marques reafirmou sua posição sobre a questão e afirmou que o TSE mudou sua jurisprudência sobre a anulação dos votos de candidatos eleitos que forem cassados. 

O entendimento foi acompanhado pelo ministro André Mendonça. “Demonstra-se absolutamente incontestável que se operou na espécie uma alteração jurisprudencial, assim como que essa foi aplicada de forma retroativa, em detrimento de expressa previsão em resolução do TSE”, afirmou Mendonça. 

Prevaleceu no julgamento o voto divergente do ministro Edson Fachin, que não referendou a decisão de Nunes Marques. Para o ministro, a liminar não poderia ser concedida pelo STF antes da análise de recurso próprio contra decisão do TSE. 

Os ministros Gilmar Mendes e Ricardo Lewandowski também não aceitaram a liminar. 

A votação ocorreu de forma virtual, na qual os ministros inserem os votos no sistema do Supremo.
